Customer / you / end user / user / buyer / referred to herein, refers to the person responsible, the owner, the buyer, and the authorised user of the unit as the same person.

GTSA provides its services to its customers by their acceptance of the following Terms of Use. If you use the services of GTSA you automatically accept these terms. Please read them carefully.

1. In case you disagree with the terms of use, please close the connection to our servers and stop using them.

2. Terms of use may change at regular intervals. It is your responsibility to be informed of these changes. GTSA will not bear any responsibility otherwise.

3. Some parts of the website may contain data exchange between GTSA employees and external customers. Opinions of this nature in no way constitute the opinions of GTSA.

4. When you visit GTSA websites, send orders or emails, contact us electronically, SMS or by phone. Therefore, you accept the right of GTSA, to contact you electronically, SMS or by phone. You agree in advance that such electronic communications, SMS and telephone and information transmitted through them meet the applicable legal requirements and rules regarding the exchange of such communications in writing.

5. Any information available from the websites of www.geniustechsa.eu / www.geniustechsa.co.za / https://geniustechsa.dedicated.co.za / www.geniustechsa.eu/store as well as the IOS and Android Genius Tech SA applications on your smart phones or smart devices must be deemed to have been registered as copyright unless otherwise stated. No information including code, text, posts, information, or images may be used without the written permission of GTSA. Failure to do so may result in criminal prosecution in accordance with European Union law

6. GTSA pays attention to the reactions and comments of customers and makes every effort to offer safe and reliable services. In no case would GTSA try to affect the operation of your machine. Nevertheless, any information used by the websites of GTSA including services and support may be incorrect. Any use of software from our website is agreed to cause damage to property belonging to the computer on which it runs. The responsibility is transferred exclusively to the software user.

7. Unless you expressly state, any application, code or other data downloaded from our servers is not guaranteed. Any information offered is given as seen, including subjective views expressed by third parties.

8. Although the marketing of surveillance equipment is perfectly legal, it is possible that their intended use by the purchaser conflicts with existing legislation, as regards protection and unlawful interference with privacy, for as long as concerns the use of personal data and, more generally, to support illegal activities in a wider range. Improper use, for purposes that are not allowed or are contrary to applicable law, are in no way encouraged or facilitated by GTSA and our websites. GTSA through its websites does not assume any responsibility, from the illegal use of its products, from the buyers as well as for the diffusion and distribution to third parties that is not allowed by the legislation. The buyer declares that he has read the above and states that he acknowledges GTSA that he does not have any civil or criminal liability, after the completion of the procedures for the purchase.

9. Take advantage of the potential of this product for legitimate purposes.

10. The use of this product for illegal purposes is not allowed.

11. By purchasing this product, the buyer is solely responsible for its smooth and legal use.

GTSA through the websites does not make any representation, expressed both for the operation or for the information, content, material or products contained therein. For this reason, the users agree to use it at their own risk. GTSA through its websites does not guarantee that the websites, the servers, or the e-mails sent by GTSA do not contain viruses or other harmful data. GTSA through its websites does not bear any responsibility for disasters of any kind that may occur from the use.

13. GTSA through its websites, tries to be as accurate as possible regarding the characteristics of the products and services that appear in our site. However, GTSA through its websites is not responsible in case the features or other content related to products sold or operated through our sites are inaccurate, incomplete, out of date, or in born with mistakes.

14. GTSA through its websites reserves the right to make any changes to the site, its policy, and the Terms of Use at any time it deems necessary.

15. The visitors of the sites automatically agree that the specific Terms of Use are subject to the Laws of the Greek State regarding any dispute that arises between the users and the site, and consequently of GTSA. Any dispute related in any way to the use of the site or to the products or services sold through it, will first be attempted to be resolved out of court. In the event that such a settlement is not reached, disputes and related issues will be resolved in the competent Courts.

16. Taking advantage of the potential of these products for legitimate purposes. The use of these products for illegal purposes is not allowed. By purchasing these products, the buyer is solely responsible for their smooth and legal use.

Protection of Personal Data

17. The management and protection of the personal data of the visitor / user of the services of the online store belonging to GTSA. Online tracking by you is subject to the terms of this section as well as the relevant provisions of the Greek (Law 2472/1997 on the protection of the individual from the protection of personal data as supplemented and amended by the decisions of the Chairman of the Committee for Personal Data Protection, PD 207/1998 and 79/2000, Article 8 of Law 2819/2000 and Law 3471/2006) and European law (directives 95/46 / EC and 97/66 / EC). These terms are formulated in the light of both the rapid development of technology and in particular the Internet and the existing - albeit underdeveloped - set of legal regulations on these issues. In this context, any relevant arrangements will be the subject of this section.

In any case, GTSA reserves the right to change the terms of protection of personal data after informing the visitors / users and within the existing or possible legal framework. If a visitor / user does not agree with the terms of protection of personal data provided in this section must not use the services of GTSA.

The personal information collected is as follows: User Services for the registration of the visitor as a user in some of the services the following data is required:

Name / Company Name - Address - Telephone - email - City – Country – Unit ID, IMEI number, sim card number. The above data, non-sensitive personal data are kept in electronic format. This information is never disclosed to third parties.

Cookies

18. Cookies of the online store owned by GTSA maybe used to identify the visitor / user of certain services and pages of the network. Cookies are small text files that are stored on the hard drive of each visitor / user and do not receive knowledge of any document or file from his computer. They are used to facilitate the access of the visitor / user regarding the use of specific services of the online store belonging to GTSA, for statistical purposes. The visitor / user of the online store belonging to GTSA can configure his server in such a way as to either warn him about the use of cookies in specific services, or not to allow the acceptance of the use cookies in no case. In case the visitor / user of the specific services and pages of the network does not wish the use of cookies for his / her identification, he / she cannot have further access to these services. Links to other websites ("Links") online store that belongs to GTSA may include links ("links") to other websites which are not controlled by the same but by third parties (natural or legal persons). In no case is GTSA responsible for the Terms of Protection of Personal Data which they follow. The IP Addresses : The IP address through which the PC has access to the Internet and then to the Network is used exclusively for the collection of statistics. General terms of protection of personal data GTSA preserves the personal character of your data and cannot transfer it to any third party (natural or legal person) for any reason with the exception of relevant provisions of the law and to the competent and principles only. GTSA maintains files with personal data, which are sent by the visitor / user exclusively for communication purposes. The visitor / user can contact the competent department in order to check the existence of the personal file, its correction, its change or deletion. Visitors / users of the GTSA services belonging to GTSA who are minors, can access the services of the Network only with the consent of their parents or guardians and have no obligation to submit their personal information. In case of submission of such data by minors, GTSA deletes the relevant information. GTSA may process part or all of the data that you have sent for statistical purposes and to improve its services - information.

During the process of retrieving personal data, GTSA applies all known security and protection methods for the confidentiality of your data. No one has access to your data, and such is stored on the software under your full control that only you know.

Online Software Server Tracking

19. In no case does GTSA, and its employees know the codes of their customers, and the customers according to our instructions are obliged to change their password codes from the first connection and at least every 3 months. GTSA takes no responsibility for accidents or accidents that may be caused to vehicles or occupants, due to misuse of our systems or defective vehicle products. The sole responsibility lies with the end user.

20. GTSA is not responsible for the tracking systems installed by other Installers. In any other area of Greece, Europe or any other country, the end user, and the respective installer – auto electrician, mechanic is responsible for the Installation and the unit working correctly.

21. GTSA and consequently the online store, our software or tracking units and our servers www.geniustechsa.eu / www.geniustechsa.co.za / https://geniustechsa.dedicated.co.za / www.geniustechsa.eu/store as well as the Genius Tech SA IOS and Android applications on your smart phones or smart devices are not responsible for the theft of your vehicle or asset, you as the customer and end user are solely responsible for management and safekeep of the vehicle, asset, and tracker.

Also GTSA is not responsible for the loss or damage to and of any vehicle, asset, or person due to theft, injury, harm, or damage due to fire, water and any other cause whatsoever. The customer indemnifies GTSA against any claim of liability from the date of purchase of any of the GTSA products and indefinitely thereafter.

22. Our tracking systems may or may not work by sending SMS notifications to the customer's mobile. If for any reason you do not have access to SMS’s, you may self-track at any time.

23. For any event that you become aware that the circumstances by us or you are not covered by these terms of this agreement, you must report it to us immediately (within 24 hours).

24. Our Company is not responsible for any disconnections of the GTSA servers, and any problems related thereof.

25. GTSA is responsible for replacing the device if it does not work as recommended by the manufacturer within 36 hours of its first operation and in no case if the customer is not satisfied within 36 hours of its operation.

26. GTSA is not obliged to 2nd product replacement after the end of the 1st replacement. It is also agreed that the defective product must be received examined by our experts within 7 days and in case of a defect and prior to been replaced within a further 3 working days. The cost of the electrician or mechanic in each case is borne by the buyer, customer/end user.

27. Minimum online server renewal and payment is 1 year. Unless otherwise agreed, the user is obliged to monitor his vehicles. Satellite tracking systems and by extension their antennas must "see" the sky to receive L1 GPS signals and not be hidden in metal spaces. In any case, our advanced systems detect satellites even when there is no contact with the sky, but it is not guaranteed for optimal operation.

28. The customer/end user is obliged to read the terms of use and accept them before the purchase and if he does not do so, you consider that he has accepted them facility.

29. The purchase of products and or services from any online store or physical store implies reading and acceptance of the terms of use. You may once again view these terms and conditions during the registration process. In case of non-acceptance, the sale is cancelled. GTSA are not responsible for the points / location where there is no mobile signal coverage (it is a matter of the service suppliers, the same goes for the data transmission time), and is not responsible for receiving satellite signals GSM and GPS in places without clear skies or underground or covered areas.

30. There are no extra charges other than those of purchasing the units which include a minimum 1-year subscription. The purchase price does not include any government tax and installation cost. The purchase price includes the Tracking Unit, a minimum of 1 year DATA subscription and access to our software for the duration of your subscription.

31. Extra charges may be brought upon the customer/end user should the Tracker be used outside its operational standards and if extensive roaming takes place without notification given to GTSA. The cards used allow cross border roaming without any extra charges, but polling of unit will be extended by GTSA to between 30 seconds and 60 seconds depending on the network provider of each country should it be recorded that a tracker has crossed any country border. The use of any unit whilst crossing a country border that requires extra costs to operate that are not covered by our minimum 1-year subscription, will be borne by the customer/end user.

32. The card supplied and installed in your unit by GTSA to allow you a minimum of 1 year connectivity is activated upon registration and is to be used solely and only with the tracking device. The use of the card for any other service is prohibited. The unit and your LOG IN connection to our server will be disabled and the unit will become inactive upon removal of the card from any of our tracking units. PLEASE DO NOT remove the card from the device during the scope of your subscription to avoid cancellation of your service.

33. Should it be discovered by our administrators or servers that the card has been removed from the tracking unit, or that a surplus of DATA is used from the authorised allocated DATA usage, an SMS or email message will be sent to you, advising of irregularity and action. Should remedial action not be taken within 24 hours the subscription will be cancelled immediately thereafter.

34. Should the subscription be cancelled by GTSA due to irregularities found of unauthorised usage of DATA card, there will be no refund to the customer (for the tracker, minimum 1 year subscription or use of our software and including any Installation costs) that customer had paid for upon purchasing of the package. At this stage after SMS and or email been sent to the customer/end user of the irregularity spotted and failure to rectify irregularity by the customer/end user within 24 hours, a termination SMS and email will be sent as final communication and cancellation of service.

35. The customer furnishes his/her active email and cell phone number upon registration, for the purpose of communication by our administrators or servers. As a customer you have a responsibility to advise GTSA of any change of your email address and cell phone number during your subscription. If no further notification is received by email at: support@geniustehsa.eu after the registration process recording your email and cell phone number, GTSA will continue to record these details as your updated and active details for the duration of your subscription. GTSA will not be held liable should you as the customer not have received any SMS and or email from our administrators or servers due to incorrect information supplied to GTSA or change of information not received by GTSA via email at any time during your subscription term.

36. GTSA reserves the right to change, upgrade or renew its software platform at any time and without prior notice.

37. A copy of the current GTSA Terms and Conditions will always be available on our website

The continuous use of our websites - www.geniustechsa.eu / www.geniustechsa.co.za / www.geniustechsa.dedicated.co.za / www.geniustechsa.eu/store, as well as the Genius Tech SA IOS and Android applications on your smart phones or smart devices indicate that you are up to date, familiar and accept the company’s current Terms and Conditions.
